Agile•1 is a leading provider of talent acquisition software, supplier management and recruitment process outsourcing, worldwide, decreasing costs, mitigating risk and maximizing the value of each new hire.  Agile•1 is committed to ensuring the security of your information. To prevent unauthorized access or disclosure, maintain data privacy, and ensure the appropriate use of information, we have put in place regimented physical, electronic, and managerial procedures to safeguard and secure the information we collect online.

Agile•1’s software suite, Acceleration is offered as a SaaS model using an ASP framework, a behind-the-firewall software and a highly secure application. The system is versatile and delivers an enterprise solution without the localized costs and resources needed to house and administer client software.

Acceleration captures personal information for workers, internal applicants, external applicants, and contractors, depending on the scope of services requested by clients. All Personally Identifiable Information (PII) is securely transferred over a public network using 128-bit encryption and HTTPS secure socket layer authentication.

Security

To maintain the privacy and security of the individuals involved, access to certain program areas will require registration. During the registration process, we collect personal and institutional contact information such as your name, address, institution name, institution address, and email address. Your contact information may be used to get in touch with you when necessary with respect to transactions conducted through the site, material changes in our site's policies, or otherwise. We do not share your contact information with any third party without your consent, with the exception of a court or governmental agency if required by law. Agile•1 restricts access to personal information to Agile•1 (or related companies) employees, contractors and agents who need to know that information in order to operate, develop or improve our services. These individuals are bound by confidentiality obligations and may be subject to discipline, including termination and criminal prosecution, if they fail to meet these obligations.

Use of Cookies

Agile•1 Web sites use a feature of your Internet browser called a cookie. Cookies are files placed within your browser on your computer’s hard drive by a web site server. Agile•1 may use cookies to facilitate your internet sessions, maintain security and to improve our web sites. For example, Agile•1 uses cookies to verify your identity and monitor your use of Agile•1 web sites to improve our services. If you choose not to enable cookies on your browser, you may not be able to use all of the services offered on Agile•1’s web sites.

Secure Network

In support of optimal user privacy and security, Agile•1 has partnered with one of the most reputable and resourceful hosting companies in the country.  Customer data resides on secured network servers and remains independent, with top-level designation.   Agile•1 controls system access and password administration, defining roles and permissions.  Data maintained by Agile•1 is protected by computer security mechanisms including firewalls, encryption, monitoring software, data segmentation and passwords.

USE OF INFORMATION

Agile•1 uses the data it collects to provide superior service to its clients and job seekers. 
Data collected ma be used to maintain any contractual or business relationship, for employment-related services where applicable, to communicate about the products and services Agile•1 offers, to contact and correspond with system users for the management and defense of legal claims and actions, compliance with court orders and other legal obligations and regulatory requirements, and as otherwise permitted by law.

Certain information for each category above may be shared with other third party companies for tax or other business related purposes.  In such cases the third party company will be required to adhere to similar privacy practices as those Agile•1 adheres to for the protection of system user information. 

Agile•1 may disclose system user information for these purposes to other Agile•1 entities, affiliates, suppliers, subcontractors who perform services on our behalf, to clients in support of job placement, an acquiring organization if Agile•1 is involved in the sale or transfer of some or all of its business, and where Agile•1 is otherwise required to do so, such as by court order.

Agile•1 may share with third parties certain pieces of aggregated, non-personal information, such as the number of user categories or types of skill sets, or geographical location. Further Agile•1 may use non-personal information to create aggregate tracking information reports regarding Web site user demographics and the use of this Web site, and then provide those reports to others.  Such information does not identify you individually.

SAFE HARBOR PRIVACY STANDARDS

Agile•1 adheres to the Safe Harbor Privacy Policy, as written by the US Department of Commerce, in consultation with the European Commission. The principles described apply to the transfer and protection of "personal information" received from the European Union (EU) or Switzerland.

Safe Harbor Privacy Principles

The following privacy principles apply to the transfer, collection, use or disclosure of personal information from the EU by Agile•1.

• Notice: At or near the time of initial data gathering:
  Agile•1 informs individuals in the EU about the purposes for which it collects and uses their personal information, how to contact Agile•1 with any inquiries or complaints, the types of third parties with which Agile•1 shares their personal information, and the choice and means Agile•1 offers for limiting the use and disclosure of their personal information.
  
  Consistent with the Safe Harbor requirements, Agile•1 may not be in a position to furnish notice in certain limited situations. Specifically, notice is not required where the processing of EU personal information is necessary to respond to a government inquiry; is required by applicable laws, court orders or government regulations; or is necessary to protect Agile•1's legal interests and providing notice would interfere with those interests.

• Choice:
  Agile•1 offers individuals the opportunity to “opt out” whether their personal information is (a) to be disclosed to a third party or (b) to be used for a purpose that is incompatible with the purpose(s) for which it was originally collected or subsequently authorized by the individual. To opt-out please contact: optout@agile1.com at any time.  However an opt-out choice may not be effectuated instantaneously and Agile•1 reserves the right to allow for a reasonable time to process such a request. Furthermore Agile•1 will require sufficient information to confirm the identity of the individual requesting the "opt out."

• Sensitive Information:
  For sensitive information (i.e. personal information specifying medical or health conditions, racial or ethnic origin, political opinions, religious or philosophical beliefs, trade union membership or information specifying the sex life of the individual), EU Individuals will be given an affirmative or explicit opt in choice before the information is to be disclosed to a third party or used for a purpose other than those for which it was originally collected or subsequently authorized by the individual through the exercise of opt in choice. In any case, Agile•1 should treat as sensitive any information received from a third party where the third party treats and identifies it as sensitive.
  
  For sensitive information, the EU Individual must explicitly opt in if the information is to be disclosed to a third party or used for a purpose other than its original purpose or the purpose authorized subsequently by the individual.

• Onward Transfer (Sharing Information with Third Parties):
  Agile•1 will only transfer personal information about EU individuals to pre-authorized third-parties(whom might be in a third non-EU country) and only where the third-party (a) has provided satisfactory assurances to Agile•1 that it will protect the information consistently with this Statement; or (b) is located in the EU or a country considered "adequate" for privacy by the EU Commission, and therefore is required to comply with the EU data protection laws or substantially equivalent privacy laws; or (c) the third-party has also certified to the Safe Harbor, and is accordingly independently responsible for complying with the Safe Harbor requirements, or enters into a written agreement with Agile•1 requiring that the third party provide at least the same level of privacy protection as is required by the relevant Principles.
  
  Where Agile•1 has knowledge that a third-party to whom it has provided EU personal information is processing that information in a manner contrary to this Statement or the Safe Harbor requirements, Agile•1 will take reasonable steps to prevent or stop the processing.

• Security:
  Agile•1 takes reasonable precautions to protect EU personal information in its possession from loss, misuse, unauthorized access, disclosure, alteration and destruction.

• Data Integrity:
  Agile•1 collects personal information that is adequate and relevant for the purposes for which it is to be processed. Agile•1 will take reasonable steps to ensure that any personal information collected or subsequently authorized by EU individuals is accurate, complete, current, reliable and used for the purposes intended. EU individuals have a responsibility to assist Agile•1 in maintaining accurate, complete and current personal information about them.

• Access:
  Upon written request to Agile•1, Agile•1 will provide EU individuals with reasonable access to their personal information. Agile•1 will also take reasonable steps to allow EU individuals to correct, amend or delete any information where it is inaccurate, except where the burden of expense of providing access would be disproportionate to the risks to the individual’s privacy in the case in question, or where the rights of persons other than the individual would be violated.  Such access might be effectuated by proving paper or electronic copies of such information and not physical access to data bases or other electronic records.

• Enforcement:
  Agile•1 has established internal mechanisms for assuring compliance with the Principles of Safe Harbor.  Agile•1 also encourages individuals covered by this Statement to raise any concerns about our processing of their personal information by contacting Agile•1 at the address below. Agile•1 will seek to resolve any concerns. Agile•1 has also agreed to participate in the dispute resolution program provided by the European Data Protection Authorities.

CHANGES

Please note that this Privacy Policy may change from time to time. Agile•1 will not reduce your rights under this Privacy Policy without your explicit consent, and Agile•1 expect most such changes will be minor.

LIMITATIONS

Adherence to these Privacy Principles may be limited to the extent required to meet any legal, governmental, national security or public interest obligations.
